SIR,

1. I have written letter –cum –construed notice to you on 10th May 2002. Copy is enclosed for your read reference. Till date, I have not received any reply. Once again, a reminder is being sent to you again to give your detailed reply responding to each of the paragraphs in a clear and detailed manner without evading to respond to each of the points made in the manner without evading to respond to each of the points in the paragraphs. Your reply shall be in form of affidavit filed before court.
2. I have drawn your attention vide above letter while drawing para 4 of the reply given by shri Ashok d shah on 7th Dec 1998 on behalf of notice given by Dhanyushya on behalf of Dhanyushya through Shri A D Shah . Dhanyushya has admitted the presence of escrow persons consisting while resenting aspersions against escrows –that is Mr. Aurabh Soparkar and Mr. Hemant Kashiparekh . In view of this as well as para 12C of my letter cum construed notice dated May 10, 2002 . You re called upon to SEEK WRITTEN CONFIRMATION from Mr. J. Jalundhwala as well as Dhanyushya Finance Pvt Ltd , WHEN THESE DOCUMENTS HAVE BEEN RECEIVED ,FROM WHOM THEY HAVE RECEIVED THE DOCUMENTS ALONG WITH WRITTEN CONFIRMATION FROM THOSE PERSONS.
3. I am also drawing your attention to the fact that Dhanyushya Finance Pvt Ltd , has not complied with th direction given by the Honourable Judge Mr. Trivedi in CRA /25 and CRA26/2002 where you appeared as counsel.
4. It is needless to say that both you and Mr.Hemant Kashiparekh has conspired and connived with Dhanyushya , Mr. Jaludhwala and you are called upon to compensate me fully for the demand notice issued by the income tax department by parting the share certificates as well as transfer deeds after the expiry date and thereby betrayed trust reposed in both of you.
5. In case if necessary, I may constrained to take legal action against you as well as Mr. Kashiparekh in case both of you do not compensate me satisfactorily for the loss and harassment suffered by betraying trust reposed in both of you on account of valuable documents handed to Dhanyushya and /or Jalundhwala or their associates without my knowledge and written confirmation.
6. This is for your knowledge and your immediate reply and does not need further reminder.
